Description of Eligibility Criteria

Claimant must be 60 or older or retired due to disability. A surviving spouse can keep the deferral if they are 57 or older and meet other criteria. The claimant's income may not exceed $40,000.

The department of revenue gives each taxing district the amount of money deferred.

Footnotes

The claimant must have fire and casualty insurance. The deferral becomes a lien on the house and is due when the property is sold, the owner passes away, or they are no longer eligible. Beginning in 2006, the interest rate on the deferral is 5%. The rate was reduced from 8% in Laws of 2006, c. 275 §1.
