| Trust Requirements | Generally referred to as “endowment lands,” these lands are held in trust pursuant to the state enabling act and state constitution, but without an express indication that these lands are to be held in trust. There are a series of restrictions on the use of these lands and the proceeds from such uses, including requirements to “secure the maximum long-term financial return” to the beneficiary and to prohibit the sale of lands for less than the “appraised price.” Lands are managed by the Idaho Department of Lands (IDL), Idaho State Board of Land Commissioners (ISBLC), consisting of the governor, superintendent of public instruction, secretary of state, attorney general, and state controller, and led by the director of the IDL who is appointed by the ISBLC. |
